Landlord and Tenant
A possession claim is a legal process used to obtain possession of a property.
This type of claim is initiated when a tenant or occupier refuses to leave the property after being given notice to vacate on a specified day. The procedure and requirements for serving a notice requiring possession and making a claim for possession will vary depending on the type of tenancy involved and the grounds for possession. In Wales, there is also the Rent Smart Wales legislation which landlords need to comply with before a claim for possession can be started.
Claims for possession are often contentious and the eviction process is highly regulated. It is important that the correct procedure is followed, and the paperwork is correct or the claim will be dismissed by the Court and the process will need to be restarted which causes wasted costs and delay.
